Cyberark End User License Agreement

13.5. Comprehensive Agreement, Performance and Modification. This Agreement supersedes all prior agreements and assurances between the Parties regarding the subject matter of this Agreement. The conditions contained in an order issued by the customer have no force or effect, even if CyberArk`s order is accepted. CyberArk may change these Terms of Use from time to time. If CyberArk does not intend to materially modify any of the above changes, CyberArk will notify the customer by email to the email address(es) indicated in the order (or will then be named in writing by the customer as the contact for CyberArk notifications), or by a banner or other striking indication inside the SaaS products or via the CyberArk support platform. If Customer does not agree with the change, Customer must notify CyberArk by email [email protected] within thirty (30) days of CyberArk`s notification. If Customer notifies CyberArk, the latest Terms of Use will apply to Customer until the end of the subscription year, and the updated Terms will apply from the beginning of the subsequent subscription. Where a provision of this Agreement is invalidated by a court having jurisdiction over the Parties to this Agreement, that provision shall be deemed new to best reflect the original intentions of the Parties, in accordance with the law in force, and the remainder of this Agreement shall remain in full force and effect. The word “including” shall be interpreted without restriction when used in this Agreement. The parties to this Agreement shall be independent contractors.
